Rideshare Accidents in Las Vegas: Who Is Liable When an Uber or Lyft Driver Hits You?

Rideshare Accidents in Las Vegas: A Complex Liability Landscape

Las Vegas is one of the busiest rideshare markets in the country. Uber and Lyft drivers are a constant presence on the Strip, at McCarran International Airport (Harry Reid International), outside casino entrances, and throughout the Las Vegas Valley around the clock. With that volume of rideshare activity comes a significant number of accidents — and when those accidents happen, figuring out who is liable and which insurance policy covers your injuries can be surprisingly complicated.

At Marathon Law Group, our Las Vegas rideshare accident attorneys understand the multi-layered insurance and liability framework governing Uber and Lyft accidents. We have helped injured passengers, pedestrians, and other drivers navigate these complex claims, and we are ready to fight for the compensation you deserve. Consultations are free, and we work on a contingency fee basis — no fee unless we win.

How Uber and Lyft Insurance Coverage Works

The critical question in any rideshare accident is what phase of the trip the driver was in at the moment of the accident. Uber and Lyft divide coverage into distinct periods based on the driver’s app status, and the applicable insurance changes dramatically depending on which period applies.

Period 0: App Offline

When a rideshare driver is operating their vehicle with the app turned off — essentially as a private driver — only their personal auto insurance applies. Uber and Lyft provide no coverage during this period. If you are injured by an Uber or Lyft driver whose app was off at the time of the accident, your claim is against the driver’s personal auto insurance policy.

Period 1: App On, Waiting for a Ride Request

When a driver has logged into the rideshare app and is waiting for a ride request but has not yet accepted one, Uber and Lyft provide contingent liability coverage. As of current regulations, this typically includes $50,000 per person / $100,000 per accident in bodily injury liability and $25,000 in property damage. However, this coverage only applies if the driver’s personal auto insurance does not cover the claim. Many personal auto policies exclude coverage for commercial driving activities, which can complicate Period 1 claims.

Period 2: Ride Accepted, En Route to Pick Up

Once a driver accepts a ride request and is driving to pick up the passenger, both Uber and Lyft provide up to $1 million in third-party liability coverage, as well as underinsured/uninsured motorist coverage and contingent comprehensive and collision coverage. This significantly expanded coverage applies from the moment the driver accepts the request.

Period 3: Passenger in the Vehicle

The same $1 million liability umbrella applies throughout the trip — from the moment the passenger gets in the vehicle until they exit at their destination. If you are injured as a passenger in an Uber or Lyft vehicle that is involved in an accident during an active trip, Uber or Lyft’s insurance should provide substantial coverage for your medical expenses, lost income, and other damages.

Nevada’s Minimum Insurance Requirements for Rideshare Drivers

Nevada requires rideshare drivers to carry a minimum of $50,000/$100,000 bodily injury liability and $20,000 property damage liability when the app is on and they are waiting for a request. For active trips, the $1 million minimum required by Nevada’s Transportation Network Company regulations applies. Nevada’s rideshare regulations are designed to ensure adequate coverage for accident victims, but navigating the claims process and holding the right parties accountable still requires legal expertise.

Underinsured Rideshare Scenarios

Even with $1 million in coverage, there are scenarios where rideshare accident victims may find themselves undercompensated. If the accident involved another negligent driver in addition to the rideshare driver, that other driver’s insurance may be the primary source of recovery — and many drivers in Nevada carry only the minimum required coverage. Additionally, disputes between the rideshare company, the driver, and their respective insurers about which period applies to the accident can delay and complicate claims. An experienced attorney is invaluable in these situations.

Our team reviews all applicable policies and, when appropriate, pursues claims against multiple parties to maximize our clients’ recovery. What to Do After a Rideshare Crash in Las Vegas

If you are involved in a rideshare accident in Las Vegas, the steps you take immediately after the crash can significantly affect your ability to recover compensation. Call 911 and get medical help. Document the driver’s name, driver’s license number, license plate, and vehicle information. Take screenshots of your trip status in the Uber or Lyft app, which will establish what period was in effect at the time of the accident. Photograph all vehicles, the scene, your injuries, and any visible damage. Get the contact information of all witnesses. Report the accident to the rideshare company through the app.

Most importantly, speak with an attorney before giving a recorded statement to any insurance company. Insurers routinely use recorded statements to minimize claims, and anything you say can be used against you. Our attorneys handle all communications with insurance companies on behalf of our clients.
