Who Can File a Nevada Wrongful Death Claim
Under NRS 41.085, a wrongful death action in Nevada is filed by the heirs of the deceased — defined as the surviving spouse, children, stepchildren, parents, and siblings in priority order. Unlike some states that require the claim to be filed only by the estate personal representative, Nevada allows heirs to file directly. Multiple heirs may join in a single action. Each heir class has priority — if a surviving spouse and children exist, more distant relatives (parents, siblings) generally do not have independent claims. The action must be filed within two years of the date of death under NRS 11.190, not two years from the accident date if there was a period between the accident and death.
Wrongful Death Damages in Nevada
Nevada wrongful death damages under NRS 41.085(2) include: grief, sorrow, and mental anguish suffered by the heirs; loss of probable support, companionship, society, comfort, and consortium; and medical and funeral expenses. Nevada does not cap non-economic damages in wrongful death cases — the full value of the loss of consortium, companionship, and grief is recoverable, which is particularly significant in cases involving a young parent of minor children. A forensic economist calculates the present value of the decedent financial support the surviving spouse and minor children would have received over the decedent remaining work life expectancy, based on actual earnings, age, education, and career trajectory. For a 35-year-old professional, the lost economic support component alone may exceed $3 million in present value terms. Survival claims under NRS 41.100 are brought in addition to wrongful death claims — they recover the conscious pain and suffering the decedent experienced between the accident and death, which can be substantial in cases where the victim survived for hours or days.
