Nevada Pedestrian Accident While Jogging or Walking Las Vegas Injury

Las Vegas pedestrians who are struck by vehicles while jogging, walking for exercise, or commuting on foot face a distinctive set of legal and practical challenges. Unlike pedestrian accidents at marked crosswalks in commercial areas, accidents involving joggers or fitness walkers often occur in residential neighborhoods, along arterial roads with partial infrastructure, or in low-light conditions during early morning or evening hours when visibility is reduced. Nevada’s pedestrian right-of-way laws are clear — motorists must yield to pedestrians — but insurance companies routinely attempt to apportion comparative fault against injured pedestrians to reduce claim value. Marathon Law Group represents Las Vegas pedestrians injured by negligent drivers while jogging, walking, or exercising on public roads.

Nevada Pedestrian Right-of-Way Law

NRS 484B.283 requires every driver to exercise due care to avoid colliding with a pedestrian on any roadway and to give warning by sounding the horn when necessary. NRS 484B.283(1) requires drivers to yield to pedestrians in marked crosswalks. NRS 484B.283(2) requires drivers to yield to pedestrians in unmarked crosswalks at intersections. Even outside of crosswalks, a driver who strikes a pedestrian in a marked bike lane, shoulder, or sidewalk area is almost certainly liable for failing to exercise the duty of care to avoid a pedestrian. NRS 484B.287 does impose a duty on pedestrians to yield to vehicles when crossing outside a crosswalk (jaywalking), and this can reduce the pedestrian’s recovery under NRS 41.141’s modified comparative fault system — but comparative fault for the pedestrian does not bar recovery unless the pedestrian is more than 50% at fault. Insurance adjusters frequently overstate jaywalking fault to pressure injured pedestrians into low settlements; an attorney can rebut this through accident reconstruction evidence and legal analysis of the actual right-of-way rules at the specific intersection.

Distracted and Impaired Drivers — Common Causes of Pedestrian Strikes

The majority of serious pedestrian accidents in Las Vegas involve driver distraction or impairment. Distracted driving pedestrian accidents commonly involve: cell phone use (texting/scrolling while driving — NRS 484B.165 handheld device prohibition + negligence per se); in-vehicle infotainment system use; looking for addresses while driving through residential neighborhoods; backing out of driveways without checking for pedestrians; and making left turns across traffic without scanning for pedestrians in the path. In early morning jogging accidents (5-8 AM is a peak time for Las Vegas joggers avoiding the heat), drivers heading to work with morning sun glare, fatigue, or in-vehicle coffee/food are common contributing factors. Cell phone subpoenas, carrier records, and in-vehicle Bluetooth/infotainment data recovered from the at-fault vehicle’s event data recorder are valuable sources of distraction evidence. Headphone/earbuds use by the pedestrian is often raised as a defense — but a pedestrian using earbuds is not in violation of any Nevada law, and the duty to avoid striking pedestrians rests on the driver regardless of the pedestrian’s earphone use.

Injuries and Damages in Pedestrian Accident Cases

Pedestrians struck by vehicles typically suffer severe injuries due to the complete absence of any protective structure around the pedestrian’s body. Common serious injuries include: traumatic brain injury from ground impact (the second impact, when the pedestrian strikes the pavement after being thrown, often causes more severe TBI than the primary vehicle impact); lower extremity fractures (femur, tibia, fibula, pelvis) from the bumper and hood strike pattern at vehicle height; thoracic injuries; spinal fractures; and significant road rash and degloving injuries from pavement contact. The absence of any occupant protection means pedestrian accident injuries tend to be catastrophic relative to vehicle-occupant accidents at similar speeds. Economic damages — medical expenses, future care costs, lost earning capacity — plus non-economic damages for pain, suffering, and disability frequently reach seven figures in serious pedestrian accident cases, and Nevada imposes no cap on non-economic damages in personal injury cases.
